SEC Opens Comment Period on Cboe 3x Bitcoin-Ethereum ETF Proposal

The U.S. Securities and Exchange Commission (SEC) has opened a public comment period on a Cboe proposal to list and trade exchange-traded funds offering three-times leveraged exposure to Bitcoin and Ethereum. The move invites feedback from investors, market participants, and other stakeholders on the structure, market impact, and investor protection considerations of the leveraged crypto products.

What the proposal entails

The filing from Cboe seeks approval to list leveraged ETFs designed to deliver three times the daily return of Bitcoin and Ethereum, respectively. Leveraged ETFs use financial techniques to amplify daily performance targets and typically reset exposure each trading day. As a result, returns over longer holding periods can diverge significantly from the underlying asset’s cumulative performance due to compounding effects and market volatility.

If approved, the products would expand the current lineup of U.S. exchange-traded vehicles tied to digital assets. U.S. markets already host spot Bitcoin and Ethereum ETFs, as well as various futures-based crypto funds; leveraged ETFs, however, introduce additional complexity and risk that regulators have historically scrutinized across asset classes.

Public comment process

The SEC’s notice opens a window for public comments on the proposed rule change. Market participants may submit views on whether the products are designed to protect investors and the public interest, as well as whether exchange rules and surveillance arrangements are sufficient to detect and deter potential manipulation.
