Judge slams SEC’s overreach in Gastauer case
The First Circuit Court of Appeals reversed the SEC’s attempt to freeze assets held by Raimund Gastauer, a relief defendant who had no role in alleged securities violations. Judges ruled that the SEC must show he received ill-gotten gains he either retains today or can disgorge without harming third parties.
